波市將實施新住宅檢查法


波士頓市議會十九日以九比四票,通過了出租住宅檢查條例(Rental Inspection Ordinance) 修訂版,在現有基礎上加強衛生安全標準的規定。
波市現有約167,800個出租單位。這一新條例將適用於其中的約85%,或140,000個單位,要求房東在未能提供房客安全、像樣的住宅單位時,得負起責任,並能很容易的辨識出來。
在未來的五年內,在該條例轄管下的每一住宅單位,將須通過檢查,或者檢查服務批准的替代性符合計劃。波市府將在第一年時,針對有不遵守規定記錄的房東,先檢查他們所擁有的住宅單位。
波市長萬寧路表示,當談到為房客提供安全、衛生的居住環境時,房東必須負起責任。這一條例將形成一主動預防的檢查過程,允許市府和業主合作,改善居民的生活品質。
波士頓環境及能源長(Chief of Environment and Energy) Brian Swett表示,房客不應該淪落到得向波市府抱怨,才能確保他們的居住單位符合最起碼的衛生、安全標準。這一條例修訂,將可在房屋住宅變得對居民有害前,就處理問題。
新條例內容包括,所有的出租單位,每年都需登記。不住在出租單位的房東,必須在明顯可見處張貼聯絡資訊。每五年必須由住宅檢查局檢查員,或受過訓練的第八類房屋檢查員,檢查一次。
針對經常未能糾正問題的房東,設立公眾可獲得的有違反規定記錄房東表。
把有問題的住宅,排在檢查名單最前面,包括那些檢查記錄不良,有重大法院及抱怨記錄,或名列波市府問題物業工作小組名單上的物業等。

Dear BALA members,
Boston Herald reported yesterday that Boston City Council voted 9-4 to approve a rental registration ordinance. Councilors Michael Ross, John Connolly, Frank Baker and Bill Linehan voted against the new law.

Below are what I copied out from the ordinance that I think are so important that we all need to know:
  1. All rental unit owners shall register annually no later than July 1st of each year and pay $25 1st and $15 each additional unit annually
  2. Owner occupied 6 units or less are exempt
  3. All non-exempt rental units must be inspected at least once every five (5) years...currently $50, or the owner may apply for an alternative “5-year” compliance inspection once every five years and pay $50 for the first unit and $10 for each additional unit in the same building.
  4. If an unit is determined to be a Problem Property as defined by Ordinance 16-55.2, must annually request an inspection from ISD. Each owner of a Problem Property shall also file with ISD an annual management plan, within 30 days of its classification as a Problem Property
  5. Any owner residing outside of the Commonwealth of Massachusetts must designate a Boston based resident agent authorized to accept service on the owner’s behalf.
  6. New property owners must register within 30 days of closing and must submit a reasonable maintenance plan that identifies and address the any significant code deficiencies within the subject property.
