Amicus Brief Filed in Federal District Court Rejects Texas Law Banning Abortions After Six Weeks

 

            BOSTON – Massachusetts Attorney General Maura Healey today led a coalition of 24 attorneys general in filing an amicus brief in support of the U.S. Department of Justice’s (DOJ) challenge to Texas’ new unconstitutional six-week ban on abortions. The brief specifically supports DOJ’s motion for a temporary restraining order and preliminary injunction of the law, which went into effect earlier this month.

 

            “This flagrantly unconstitutional law unleashes bounty-hunting vigilantes to get in the way of someone’s right to basic healthcare,” AG Healey said. “As leaders in the fight to preserve healthcare and access to abortion, we will protect reproductive rights for every person in our states, and we stand with the Department of Justice in fighting to stop this dangerous law from putting the lives of our residents at risk.”

 

            The brief, filed today in the United States District Court for the Western District of Texas, argues that by banning nearly all pre-viability abortions within Texas’s borders, the law, Senate Bill 8 (S.B. 8), violates nearly 50 years of Supreme Court precedent affirming the constitutional right to terminate a pregnancy before viability. The brief further contends that the Texas Legislature sought to circumvent prior Supreme Court rulings and to prevent judicial review of the law by delegating enforcement authority to private individuals instead of the government and, as such, S.B. 8 is an “unprecedented attack on our constitutional order” and the rule of law. 

 

            The coalition contends that the clear purpose of S.B. 8’s private enforcement scheme is to produce an “across-the-board ban on constitutionally protected activity,” and that the private enforcement mechanism does not shield Texas’s unconstitutional law from judicial review. The brief describes how Texas created a structure within its state court system that requires courts to provide monetary and injunctive relief to claimants who bring cases against providers and those who “aid or abet” such constitutionally protected care. The coalition argues that the federal district court should not allow Texas to render the constitutionally protected rights recognized in Roe v. Wade legally void through the law’s transparent scheme. 

 

The brief describes how the law is already significantly impacting abortion provider clinics in Texas and beyond, including in amici states. Clinics in nearby states are already reporting a rise in calls from Texas patients seeking abortions, and one day after the law went into effect, all abortion clinics in New Mexico were reportedly booked for weeks. This rise in abortion caseloads in other states from Texas patients and the increase in needed travel for patients could result in many people – especially low-income people – being unable to receive the care they need. The law also threatens the many people who help patients in Texas obtain access to an abortion by creating a more than $10,000 potential liability for anyone who so much as gives a patient a ride to an abortion provider or otherwise “aids or abets” an abortion. The amici states, the brief explains, are committed to shielding their residents and clinicians from these harms when they help a patient in Texas obtain constitutionally protected care.

 

            Finally, the brief argues that it is essential for the federal district court to enjoin the law immediately to stop the irreparable harm that S.B. 8 is inflicting on people in Texas and across the country including the amici states. Forcing a patient to carry an unwanted pregnancy to term, the brief argues, will lead to negative health and socioeconomic consequences, including placing people who are forced to carry a pregnancy to term at greater risk of life-threatening illnesses and harming their ability to maintain full-time employment.

 

Joining AG Healey in filing the brief are the attorneys general of California, Colorado, Connecticut, Delaware, the District of Columbia, Hawaii, Illinois, Maine, Maryland, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, Washington, and Wisconsin.

 

This matter is being handled for Massachusetts by Assistant Attorney General Amanda Hainsworth and Division Chief Abigail Taylor, both of AG Healey’s Civil Rights Division, as well as State Solicitor Bessie Dewar.

                 (Boston Orange 周菊子波士頓綜合報導) 波士頓選務局計票工作停頓3小時後,CampbellJaney相繼退讓,於是儘管才只開票5.49%,波士頓市長初選結果已昭然若揭,112日將是Annissa Essaibi George和吳弭 (Michelle Wu) 的爭戰。

                  投票站是8點關門的,波士頓選務局直到10點半,才開出0.39%選票,然後就停滯不動了。各方頻頻查問後,波士頓選務局表示是有78000張郵寄選票,趕在最後一刻抵達,該局必須核對郵寄選票的選民,有沒又親自出席投票,所以延宕了選票計算。麻州選務局也在推特上幫忙解釋。

             914日下午5點多時,波士頓華埠設在青年會(YMCA)內的投票站,已有755人投了票。一名工作人員抱著一疊,她說是郵寄來的選票,一張張的餵進記票機

                    不過,5名候選人各有自己的團隊在計算各投票站的投票情況,於是晚上10點後,吳弭決定不等了,由麻州眾議員麥家威(Aaron Michlewitz),薩福克郡治安官Steve Tompkins,波士頓市議員Lydia Edwards 等人陪同,在羅森岱爾的Distraction釀酒公司露臺舉辦的初選夜派對上,含笑感謝選民,強調這是選民們關於未來的選擇,很興奮要開始下一階段的選戰。1155分時,吳弭的競選團隊也發出書面新聞稿,宣布初選勝利。

               Annissa Essaibi George則是在靠近Neponset河的水畔餐廳Venezia,和支持者一起慶祝。她笑說,雖然開票還在進行,但不妨礙慶祝。

                 然後,1135分,Andrea Campbell宣佈退讓,佈勝利,午夜過後,波士頓代市長Kim Janey也以書面聲明退讓,於是儘管選票計算有如牛步拖車般,直到午夜過後,也才只開票5.49%WCVB電視台直播了Annissa Essaibi George4名兒子一一上台後,站到麥克風前向支持者致詞。

“I want to thank my family, friends, supporters, campaign staff, and volunteers for all the work we have done together over the past five months. I can’t tell you how much I appreciate all the doors that were knocked, all the calls that were made, and all the early mornings and late nights spent working to make history here in Boston.

While we are still waiting on some results, it appears that we have come up short in the election. I want to congratulate Michelle Wu and Annissa Essaibi-George on their victories this evening. This was a spirited and historic race, and I wish them both luck in the final election. 

While tonight hasn’t ended how we hoped, we have so much to be proud of. On the campaign side we built a multi-racial, multicultural, and multi-generational coalition committed to making Boston a more just, more equitable place to live for every single resident.

And at City Hall — as the first woman and first Black Mayor of Boston — we not only made history, but we made a difference. Crime is down, people are staying in their homes due to work we’ve done with rental assistance and an eviction moratorium, our children are safely back in school, and Boston is one of the most vaccinated big cities in America.

There is so much more we have done together in these few months that we can be proud of — that helped people of our city in their time of greatest need and set Boston on a path to an equitable reopening, recovery, and renewal.

Over the next two months, I am committed to continuing to lead Boston through these challenges — to continue to get shots in arms, keep our kids safe in school, keep our streets safe, and keep our residents housed. 吳弭肯定打入11月大選 10點臉書直播致詞

               (Boston Orange 周菊子綜合報導) 晚上8點,投票站關門了,波士頓選務局在推特上報告,今天(914) 的波士頓初選,只有83,602人出席投票。到了晚上1030分,波士頓選務局網站上的數據仍然掛零,波士頓環球報網站每隔15秒更新一次的即時選情資訊也仍然只報出開票0.39%,吳弭暫時領先,得233票的非正式結果。

              根據波士頓市選務局資訊,民眾對市級選舉的初選一向不太關心。2013年,當波士頓市20年來第一次市長席位出缺,有將近12人參選角逐,全市有30多萬已登記選民,卻只有113,319人,約30.78%的選民在初選中出席投了票。到2017年馬丁華殊 (Martin Walsh)競選連任,有不下5人參選時,也只有56400人在初選中投了票,投票率僅約14.46%

              波士頓的公共電視台在投票站關門前,請波士頓環球報的副編輯,以及一名資深公視政治記者猜測,誰會打入大選,2人竟不約而同地認為,如無意外,會是華裔的吳弭和阿拉伯裔及波蘭裔後代的Annissa Essaibi George

              然後,在這科技早已與時俱進到5G時代的今日,僅只8萬餘的選票,卻遲遲交不出計算選票的更新資訊。

              (Boston Orange 整理編譯) 波士頓市長候選人們今 (14) 日自己投完票後,馬不停蹄地展開拜票之旅,敦促選民出席投票,更請他們別忘了投自己一票。

              波士頓說大不小,也是個有48.4平方英里的城市,來到2020年時,總人口已增加到675647人,是新英格蘭內人口最多的城市。

              根據維基百科,波士頓市從1854年開始選舉市長,起初每年選一次,1900年以後,然後每2年選一次,大戰期間,選舉也當然停頓,從1941年開始,大約都是每4年選一次,迄今已辦過不下167次市長選舉。

              今年的市長選舉,由於參選者背景之多元化,還不到大選日子,人們就已經知道,無論是誰當選,波士頓市今年都將締造歷史紀錄,選出一名女性有色人種當市長。至於這顏色是黑色,黃色或阿拉伯裔的顏色,還待選票決定,也是看那個候選人的支持者更願意出席投票。

              各市長候選人在這兩日的拜票行程中,不時也發表些看法。Annissa Essaibi-George在南波士頓拜票時,邊吃著熱狗,冰淇淋,邊說,選民們對聆聽施政計畫的興趣,遠不如搞清楚誰最值得信任高。她說,選民們最想知道的是,他們的未來市長是否關心她們在關心的事,是不是負責任,是不是她們接觸得到的人。

              波士頓代市長Kim Janey和幾十名在這兒團結本地26工會成員們,敲門拜票,在Grove Hall舉牌時坦言,當5個月代市長的經歷,就像一把2面刃,但是她為自己在這麼短的時間內,做了這麼多事,包括犯罪率下降,接種疫苗率高達70%以上,紓緩人們的租貸壓力等感到很驕傲。她相信只要選民們再給她4年時間,她可以為民眾做更多事。

波士頓市不分區市議員吳弭(Michelle Wu)的民調一路領先,有她當年的哈佛老師,現在的聯邦參議員伊莉莎白沃倫(Elizabeth Warren),以及許多有份量民意代表支持。她的比較激進理念,包括強調環境保護,公共交通工具免費等,也贏得許多草根群眾支持。根據競選經費辦公室的捐款記錄分析,在一種候選人中,吳弭贏得的小額捐款數也最高。不過吳弭強調,我從來不相信民調,尤其是這場選戰,有太多影響因素了

波士頓市第4區市議員Andrea Campbell913日晚,回到她長大的南端法蘭克林廣場公園,和近百名支持者晤面。她再次重述她和攣生兄弟Andrew幾乎相差180度的人生經歷,她自己能夠進波士頓進最好的公立學校,得到普林斯頓大學畢業的學歷,當上市議員,而她的攣生兄弟,卻在整體來說對黑人不利的大環境中,陷入深淵,死於獄中。她因此深信,波士頓市是個有潛力的城市,她要把波士頓市造就她的那一面,發揚光大,帶給所有人。

對亞裔來說,麻州今年的選舉十分熱鬧,波士頓市有吳弭參選市長,牛頓市有馬惠美(Amy Mah Sangiolo)第二度參選牛頓市市長,昆士市有現為該市市議會議長的梁秀婷(Nina Liang)競選連任不分區市議員,摩頓市也有Nate Bae Kupel競選第8區市議員。

                        大波士頓地區的華裔居民,在紐約楊安澤擠進美國總統候選人行列,大環境的華人要為自己發聲等情勢鼓勵下,已有越來越多人關注選舉。不過華人之間意見頗為分歧,各自支持不同候選人,想要在政治界形成影響力量,一時間恐怕還是不容易。

摩頓市有亞裔Nate Bae Kupel競選第8區市議員

                 (Boston Orange 整理編譯) 摩頓市 (Malden) 8選區因為有3人角逐,914日必須辦理初選。Nate Bae Kupel則是這場選舉中,唯一的亞裔候選人。

               Nate Bae Kupel將和在位的Jadeane Sica,以及另一名參選人Amy Friedman競爭摩頓市第八區市議員席位。

             現年37歲的Nate Bae Kupel,民主黨籍,麻州大學Amherst分校社會學畢業,再取得西蒙斯(Simmons)大學碩士學位,在非牟利機構已工作15年,還是政治素人。他和妻子Qingjian Shi搬到摩頓市才5年多,但已愛上這裏,想要植根於此,因而決定參選市議員,加入高地村(Highland Village)這第8區選戰,為打造能為人民提供更好服務的市政府,出一分力。

Nate Bae Kupel目前是麻州總檢察官所指派的麻州亞美局 (AAC)委員,曾經在爭取高等教育的可負擔性,青年賦能及職業培訓,社工,協助弱勢社區取得醫療護理,領導力發展等領域的好幾個非牟利組織擔任會長,執行長等職務。

Nate Bae Kupel的競選網站 (www.natebaekupel.com )上,有英,中,西班牙文,葡萄牙文,越南文,韓文等6種語言的自我介紹。他透露自己在韓國出生,被領養後在緬因州長大,12年前經養父母協助,與生母團聚。這人生經歷形成了他以助人為已任的使命感。

             他決定參選是希望把摩頓市變成一個更平等,乾淨,綠化,宜人的城市。他想要透過教育、公共交通工具等,來幫助、改善居民和市政府之間的溝通及信任,以及問責程度。

             他說,毫無疑義的,目前最急迫的問題是新冠病毒疫情,市政府如何因應,如何增加疫苗接種率,如何讓人民了解疫情對社會經濟的影響,如何做妥善因應計畫,如何收集社區需要數據,主動的為未來制定計畫,都對人民的生活品質與安全有很大影響。

             他認為市政府應該要做的事情包括,1. 再做社區健康需要評估,尤其是新冠病毒疫情發生後,整個社會情況變化那麼大。2. 其次增加對非牟利服務機構的投資,設立補助項目,在便利店等場所,為社區提供更多取得健康食品的管道,3. 研擬並制定社區大使團模式,讓每個社區在更小範圍內都有人可以用居民們自己的語言來了解居民們的需要,為他們的疑問,提供解答管道與資訊。

             Nate Bae Kupel認為自己和其他2名候選人最大的不同在於,他的社工背景,讓他能更好的聆聽,並了解居民們的需求,為居民和市政府搭起橋樑。他指出,去年摩頓市政府和重建局完成了99號公路/百老匯迴廊 (Route 99/Broadway Corridor) 的土地使用及經濟發展計畫,根據居民的回饋意見,把如何鼓勵小企業發展,增加綠地,加強行人及開車、騎自行車安全等因素考慮進去了,但這計畫從202010月制定後,卻無實施前述建議的辦法,市府和社區居民間的對話,顯然應再加強。

             摩頓市是個人口僅約60,984的小城市,近年來亞裔人口快速增長,已達13,732人,在總人口中佔了22.5%,其中華裔8,045,約佔總人口的13.2%,但迄今還無亞裔民代。Nate Bae Kupel可能也是第一個參選摩頓市議員的亞裔。

波士頓9月14日初選 市長候選人紛搬重量級支持者站台

                (Boston Orange 周菊子綜合報導) 波士頓市長候選人們這兩天為了初選,到處拜票,忙翻了。13日傍晚還在最後衝刺,紛紛發佈14日行程,提醒選民,記得晚上8點前去投票。

               14日這天一早7點,波士頓代市長金珍妮 (Kim Janey) 會到洛士百利 (Roxbury) Yawkey男女童軍俱樂部投票,接著去馬丁路德金塔,南端的天滿街,以及城中區,牙買加平原等多個投票站拜票。波士頓市議員Andrea Campbell早上7點會到多徹斯特的波士頓公共圖書館下磨坊 (Lower Mills)分館投票,然後到牙買加平原,麥特潘Mildred大到學校,Groveland社區室,波士頓的Codman廣場,東波士頓高中,查理士城Kent學校,洛士百利男女童軍俱樂部,羅森戴爾,西洛士百利,波士頓三一學校等16個地點拜票,兩人的行程都排得密密麻麻,真是在為選舉催票。

             波士頓市不分區市議員吳弭(Mihcelle Wu)在上週末一連兩天的行程,也密集得不得了,陸續有聯邦參議員Elizabeth Warren,麻州眾議員麥家威(Aaron Michlewitz),薩福克郡治安官Steve Tompkins,波士頓市議員Lydia Edwards,以及從康州來的總檢察官湯偉麟(William Tong),從紐約來的州議員牛毓琳等許多人為她站台助選,再分赴各地,為她拉票後,14日這天的行程,起先只只公佈了她會在早上8點多一點,到Phineas Bates小學投票,到晚上將近10點時,卻一口氣公佈12個拜票地點,而且每一站都有重量級支持者陪同,包括薩福克郡治安官Steve Tompkins,麻州眾議員麥家威,紐約州議員牛毓琳等人,儼然鐵了心的要在氣勢上勝人一籌。

              Andrea Campbell不但趕在13日傍晚,到她小時候居處附近,位於南端的法蘭克林廣場,辦了一場有近百人出席的出來投票(GOTV)”最後衝刺競選活動,邀來有亞美婦女政治計畫(Asian-American Women’s Political Initiative)”創辦人黃子瑜,以及曾經的麻州眾議員,州政府精神疾病項目主管等人站台,感謝她們勇敢的決定支持她,更以15分鐘的演講重申她參選不是為自己,是要為波士頓帶來改變的契機。

                         麻州總檢察官奚莉(Maura Healey)竟然也在13日發出電郵,提醒麻州選民,9月14日,波士頓市,摩頓市,昆士市,牛頓市等15個市鎮,都辦理初選,有意投票者,應及早準備。她還提供了麻州州務卿辦公室的選舉網頁,讓人更方便的查詢選舉相關資訊。根據該網站,今年共有28個市鎮需要辦理初選。包括摩頓市(Malden) 的第八選區市議員選舉,其中有5個市鎮指辦理區域性初選。11月2日那天,則是所有市鎮都將辦理大選。

波士頓市新市長將於11月誕生 肯定是名女市長

               (Boston Orange 周菊子綜合報導) 明天(14) 晚上8點以後,波士頓市的下屆市長將跨入非你即我2人爭戰,而112日大選後,贏得最多選票者,不必等明年,11月中就可坐上市長寶座。

                                                                          熟悉選務者指出,波士頓市前市長馬丁華殊(Martin Walsh)遠赴華府出任聯邦勞工部部長後,金珍妮(Kim Janey)是以市議會議長身份,暫代市長職務。根據選舉法,一旦民選市長誕生,當選者應在選舉結果經認證後,估計在10天到2星期之內,盡快就任。

                                                                          在波士頓選務局的市長候選人名單上,波士頓市長候選人其實有8人。其中的現任麻州眾議員Jon Santiago7月時已宣佈退出市長選戰,其餘7人中,有2人名不見經傳,各媒體在報導市長選戰時,各機構或組織辦理市長選舉論壇時,彷彿都遺忘了還有這2人存在。

                                                                         1993年的時任波士頓市長,也是波士頓市現任市議員愛德華費林 (Ed Flynn) 父親的雷夫連(Ray Flynn)當上梵蒂岡大使後,當年代理市長職務的波士頓市議會議長萬寧路(Tom Menino)也是在競選市長,贏得最高票,順利當選後,於11月就任為正式市長。

                                                                      今年的這次市長選舉和當年有點像,只是萬一現在代理市長職位的金珍妮沒選上的話,波士頓市就會出現一年之內有3名市長的歷史紀錄。

                                                                            在一連4次的民意調查中,吳弭的支持率始終領先,上週四公佈的愛默生學院和第7號新聞所做的民意調查,也顯示吳弭的支持率有30%Annissa Essaibi George 18%Andrea Campbell 17%Kim Janey 16%,其他人6%。這一民調,似乎擺明著今年的波士頓市長選戰是場女人戰爭,連候選人John Barros的名字,也竟然在這次民調中消失了。

                                                                明天晚上誰能擠進112日的大選,誰能鼓動更多支持者投票,似乎比往年的選舉更加重要。

                                                                               麻州公司(MassINC)的民意調查集團董事長Steve Koczela認為,如果出席投票的趨勢走傳統路線,對Annissa Essaibi George有利。如果多元背景的選民出席投票率高,就對Kim Janey有利。至於Andrea Campbell能贏得多少選票,可能和出席投票率沒那麼大的關係。

                                                          根據波士頓選務局資料,已經有21000人投了票。截至上週五,波士頓選務局供收到16,000張郵寄選票,另有5千多人親自提早投了票。

BOSTON - Monday, September 13, 2021 - After two successful Open Newbury Street events in August 2021, Mayor Kim Janey and the Boston Department of Transportation have announced that Newbury Street will again be pedestrian-only on Sunday, September 26. Open Newbury Street provides exciting new opportunities for businesses to engage their customers and benefit from repurposed street space that makes it easier to browse and enjoy the outdoors. 

“Open Newbury Street provides a unique opportunity to expand access to one of Boston’s flagship destinations,” said Mayor Janey. “I encourage residents and visitors to support our small businesses impacted during the pandemic and enjoy a day of open-air shopping and dining.”

“It lends a really fun atmosphere for the whole street — everybody is in a good mood, everyone is smiling, everyone is excited to see what merchants are doing,” said Kathy Palmer, President of The Fish & Bone pet supply shop. “[Merchants] are excited to open up again - our stores are very small so it was hard to have capacity limits in the last year. Having the ability to bring your brand out onto the street in the open air where everyone is safe and there’s no fear of being too close, that really helps!” 

Newbury Street will be open to pedestrians and closed to motor vehicles from 10:00 a.m. to 8:00 p.m. from Berkeley Street to Massachusetts Avenue. Parking will be restricted on Newbury Street and adjacent streets, with enforcement beginning at 5:00 a.m. Signs will be posted informing drivers of the change. 

Businesses and attendees are encouraged to promote the event on social media using #OpenNewbury. The public is encouraged to utilize the several different MBTA routes that service the area in addition to bicycling and walking.
