昆士市12/2發生歧視亞裔 開車撞人案

            (Boston Orange 編譯) 昆士市在12月2日早上發生一宗仇視亞裔暴力案件。一名77歲嫌犯向一家越南人嗆言「回中國去」，其後又開車把其中一人撞得飛起，跌進建築工地溝渠。警方已逮捕嫌犯，預定週三再次出庭。

2日下午，昆士市地方法院法官已下令拘押77歲的John Sullivan，等週三再召開危險性聽證會。

受害者的姊姊Desiree Thien說，38歲的George Ngo被撞得多處受傷，腦震盪，目前在家休養。

她在接受媒體電話訪問時說，那天早上快要11點時，她帶著3個小孩和George Ngo從華盛頓街的郵局走出來，John Sullivan突然就開始對著他們狂飆辱罵族裔的話。

上週五 (2日)庭訊時，John Sullivan對使用武器攻擊和毆打，以及違反民權，草率駕駛，在車輛造成他人受傷後離開現場等2項控訴辯稱無罪。

警方表示，Sullivan當時開車到郵局附近時，和批評他開太快的路人互罵。Desiree Thien說，當Sullivan在靠近郵局處停車時，她和弟弟沒有對Sullivan說任何話，但是他一下車就開始罵她們。

Thien說，Sullivan叫他們「回中國去」，她就告訴Sullivan她要叫警察。Sullivan還在下車時對她們說，他要進郵局，等他出來時，最好她們都已經離開了，否則他會把她們全都殺了。

Sullivan走進郵局後，她們一家就站在Sullivan的車前拍照存證。幾分鐘後，當Sullivan從郵局走出來，衝突就更嚴重了。Sullivan一邊坐回他的車，一邊持續囂叫辱罵她們，然後把車加速，向著她和George Ngo衝過來。Ngo把她推開了，自己就被車撞得滾到車前蓋上，掛在那兒，車還繼續開了200多英尺。

Thien說，Sullivan突然踩剎車，在Foster街的交界處，把Ngo從車前蓋摔到地上去。一等Ngo站起來，Sullivan又再撞Ngo一次，把Ngo撞得飛起來，跌進旁邊的建築工地溝渠去了。

工地工人們很快地接近Sullivan的車，叫他下車，等警察來。可是Sullivan開車向Braintreen的方向走了。一名工人立刻上了卡車去追Sullivan。

Norfolk地方檢察官辦公室發言人David Traub說，在昆士市警察向地方部門廣播車輛訊息後，Braintree警察通知昆市當局，有輛車涉及車禍事件，正是同一個車牌號碼。Braintree於是關押Sullivan，直到昆士市警察來到拘留了他。

Thien告訴媒體，她們家在1986年從越南到阿肯色州，再來昆士市定居至今。她們家開了一家地板公司，已經有30多年了。她為自己分別為9、10、11歲的3個小孩目睹了這事件，感到非常氣憤。她很不希望自己的小孩見到這種事情發生，更不希望她們也成為種族歧視的受害者。她告誡自己的孩子，萬一遇到這樣的事，就打拿出手機，拍照，錄影，看到別人遭遇類似事營，就要發聲，不要沉默，不要被嚇到。她說，大家都需要發生，以制止美國內的仇恨和歧視。

Thien說，Sullivan需要知道，沒人可以凌駕於法律之上。

Born in Taiwan, he immigrated to America at the age of 3.  He serves as a colonel in the United States Air Force Reserve Command and represents the 33rd congressional district of California.

AG HEALEY ANNOUNCES $1 MILLION MULTISTATE SETTLEMENT WITH CARMAX OVER FAILURE TO DISCLOSE SAFETY RECALLS   

Joins AG Coalition Alleging Company Violated States’ Consumer Protection Laws 

BOSTON – Attorney General Maura Healey today announced her office joined a coalition of 35 attorneys general in reaching a settlement with CarMax Auto Superstores, Inc., following an investigation into the company for illegally selling used vehicles with open recalls, despite claiming to sell “safe” vehicles.  

According to the assurance of discontinuance, the states allege that CarMax, which is headquartered in Virginia, participated in deceptive advertising by telling consumers that its reporting and inspecting practices ensured it was selling “safe” cars. In reality, CarMax had allowed for vehicles with open recalls related to their safety to be sold without proper inspection, and without disclosures to buyers. 

“Buying a vehicle is a significant financial expense for many families and individuals, and they need to be sure that the car they are purchasing is both operational and safe,” said AG Healey. “Under this industry-changing settlement, CarMax will pay for its practices and be required to make important safety disclosures to consumers shopping for cars.”   

Federal statutes, such as the Motor Vehicle Safety Act, prohibit the sale of new vehicles with open recalls, however, no such statutory prohibition exists for the sale of used vehicles with open recalls. This settlement establishes precedent for a requirement that used car dealers disclose open safety recalls to consumers before they buy. As a result, CarMax will present the consumer with copies of any open recalls and obtain the consumer’s signature on a standalone disclosure document before presenting any other sales paperwork. CarMax has agreed to not falsely represent vehicles as “safe.”.  

Additionally, CarMax now includes hyperlinks for vehicles advertised online and QR codes for vehicles on the lot that link directly to any open recalls on the vehicle, allowing consumers to access the data as they shop.  

CarMax will continue to use the National Highway Traffic and Safety Administration’s vehicle identification number tool to provide important safety information to consumers. Consumers also have access to this tool and are able to check it for any open recalls on their vehicles. 

CarMax is further required to pay the states $1 million, with approximately $21,000 going to Massachusetts. 

Joining AG Healey in today’s settlement, led by Illinois Attorney General Kwame Raoul, are the states of Alabama, Arizona, Arkansas, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Iowa, Kansas, Kentucky, Louisiana, Michigan, Minnesota, Mississippi, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Utah, Virginia, Washington, West Virginia, and Wisconsin. 

This case was handled for Massachusetts by Deputy Division Chief Mychii Snape and Division Chief Shennan Kavanagh of the AG’s Consumer Protection Division, as well as Deputy Division Chief Krystle Carvalho of the Consumer Advocacy and Response Division.

 

Baker-Polito Administration Celebrates Broadband Expansion Progress

Since 2016, Last Mile Program Delivered High-Speed Internet to 26,000 Premises across 53 Towns

ASHFIELD – Today, the Baker-Polito Administration celebrated the impacts of the Last Mile infrastructure program and discussed new investments to support broadband access and digital equity programs across Massachusetts. To date, the Last Mile infrastructure program has delivered high-speed internet access to approximately 26,000 premises, including households and small businesses, across 53 towns in north-central and western Massachusetts. During the event, the Baker-Polito Administration also detailed its strategy to leverage over $350 million in anticipated state and federal funding to address digital equity and broadband infrastructure gaps that exist statewide, an effort which will build on the success and learnings from the Last Mile program and initial COVID response. Governor Charlie Baker, Lt. Governor Karyn Polito, and Housing and Economic Development Secretary Mike Kennealy joined state and local leaders for the event in Ashfield, a community that was previously “unserved” by broadband and gained access through the Last Mile program.   “Since taking office, our Administration has been proud to develop and support the Last Mile with over $57 million dollars to provide residents in 53 towns in north-central and western Massachusetts with access to basic needs and online resources for their small businesses, for their schoolwork, and to better manage their healthcare,” said Governor Charlie Baker. “Our Administration made the Last Mile one of our key priorities, as we saw high-speed internet connectivity as a critical need for the future of these small towns and we know the benefits will continue long into the future.”   “The success of the Last Mile program was supported by the time, energy, and investment of our local partners in these small communities,” said Lt. Governor Karyn Polito. “From the state side, our investments were aided by the partnership we received from the private companies and utilities involved in each of these projects, who participated in regular meetings to identify roadblocks and coordinate resources to expedite individual projects. Years of planning and construction have led to today, with homes and businesses online and residents that are benefitting from this 21st Century connectivity.”   Re-launched by the Baker-Polito Administration in 2016, the Last Mile program sought to bring high-speed internet through a flexible, responsive, and community-based approach to 53 communities in central and western Massachusetts that either completely lacked broadband infrastructure (44 unserved towns) or had large areas where infrastructure was lacking (nine partially served or underserved towns). Today, 46 of the 53 Last Mile towns have completed projects that are “fully operational” (delivering high-speed connectivity to at least 96% of premises within a community) and the remaining communities have networks that are “partially operational,” with additional customer connections that are ongoing or in final stages of construction. The Last Mile effort was made possible through a partnership among state government, municipalities, private providers, utilities, and construction contractors.   The Commonwealth invested over $57 million in direct state grants through the Last Mile program, which supported:   Construction of municipally-owned networks, including in Ashfield, which were aided by the utility Westfield Gas+Electric; Private provider-led projects, opportunities identified through public procurements launched by the Massachusetts Broadband Institute (MBI), opportunities which included the Broadband Extension Program (for nine ‘partially-served’ towns), and the Flexible Grant Program. Through these efforts, companies such as Comcast, Charter Communications, Fiber Connect, and WiValley received grants to complete projects in un- and under-served towns. A map of the completion status, as well as a map showing the different project partners for each community, can be found on the Last Mile program page.   “Today’s event is a celebration of the momentous effort that has been undertaken at the local and state level to get Last Mile communities connected to high-speed internet, a necessary tool to compete in today’s economy,” said Housing and Economic Development Secretary Mike Kennealy. “We have closed gaps in central and western Massachusetts, and are now launching new statewide infrastructure and digital equity programs to further expand infrastructure and continue our work to bring devices, digital skills training, and affordability support that will improve access to the internet.”   During the event, the Baker-Polito Administration also discussed its strategy to leverage over $350 million in anticipated state and federal funding to launch programs to address digital equity challenges statewide, including efforts to make high-speed internet more affordable, increase access to internet-enabled devices, and boost digital literacy and training: A Digital Equity Partnerships Program, which will support organizations, including Regional Planning Agencies, philanthropic foundations, and public and nonprofit service providers, to launch programs that address enhanced internet access, digital literacy, availability of devices, and education and outreach efforts. A Municipal Digital Equity Planning Program, which will enable municipalities to undertake digital equity planning activities with prequalified consultants to understand how internet access, or lack thereof, affects their residents. An infrastructure program to address remaining coverage gaps in every city and town in Massachusetts, to be launched by the MBI and the Executive Office of Housing and Economic Development and informed by successes of the Last Mile program. A statewide mapping portal launched by the MBI to provide an overview of the current state of high-speed internet access across Massachusetts, built on data voluntarily provided by private providers. The portal, which is currently in public beta, will be further refined and will both support the Federal Communication Commission’s (FCC) ongoing mapping process and impact funding allocations to the Commonwealth. A Broadband and Digital Equity Working Group to advise and assist on the stakeholder outreach and planning process related to state and federal funding. The new digital equity programs build on the initiatives launched by the Commonwealth in response to the COVID-19 public health crisis, which included public Wi-Fi hotspots in the remaining unserved towns and the Mass Internet Connect program, which worked with MassHire to provide financial support and digital literacy tools to help get unemployed residents back to work. In late 2021, these efforts were extended and new digital equity partnerships with organizations including Essex County Community Foundation and the Metropolitan Area Planning Council were created. The MBI also made a $1 million grant to Boston-based Tech Goes Home to expand the organization’s work statewide.   “Connecting the unconnected has been a priority throughout the Baker-Polito Administration, with the COVID-19 pandemic underscoring the importance of ensuring internet access statewide and, in particular, in our most vulnerable communities,” said Undersecretary of Community Development Ashley Stolba. “We are grateful to the many public and private partners who have supported efforts to expand internet access in Massachusetts and who will continue to play a critical role as we work to further address infrastructure gaps, promote internet adoption, and reduce digital inequities moving forward.”   “The programs launched today will be directly informed by the legacy projects we’ve managed at the MBI, including the Last Mile effort and the initiatives launched in 2020,” said Carolyn Kirk, Executive Director of the MassTech Collaborative, the parent agency of the MBI. “This includes technical and program knowledge, but also the relationships we’ve built with stakeholders in the state, community leaders and non-profits that are leading the charge around digital equity. The funds that are allocated will only be effective with the input and buy-in from these stakeholders, to shape the programs so that they have the greatest impact statewide.”   During the event, community leaders weighed in on the impact of the Baker-Polito Administration’s broadband investments in their communities, generating new opportunities around economic development, learning, and to access critical healthcare resources.   The impact of the statewide programs were also celebrated by members of the Massachusetts legislature, several of who were in attendance at the event in Ashfield, along with their constituents. “Today’s celebration was a testament to the strength and resiliency of some our tiniest – but mightiest – towns in the Commonwealth,” said Representative Natalie M. Blais. “As a result of our collective efforts, previously unserved towns now have the technology that will help them thrive. BOSTON – This week, Governor Charlie Baker nominated Attorney Michael A. Cahillane as Associate Justice of the Superior Court and Acting Clerk Magistrate Jennifer Lennon as Clerk Magistrate of the Marlborough District Court.

 

“Attorney Cahillane and Acting Clerk Magistrate Lennon will bring valuable knowledge and experience to their new roles if confirmed,” said Governor Charlie Baker. “We are proud to submit their nominations for consideration.”

The Superior Court, the trial court of general jurisdiction for Massachusetts, is committed to delivering high quality justice in a timely and fair manner in accordance with the rule of law. The Court's 82 justices sit in 20 courthouses in all 14 counties of the Commonwealth. The Superior Court has original jurisdiction in civil actions over $25,000 and in matters where equitable relief is sought. It also has original jurisdiction in actions including labor disputes where injunctive relief is sought, exclusive authority to convene medical malpractice tribunals, appellate jurisdiction over certain administrative proceedings, and may hold sittings for naturalization in any city or town. Michael A. Cahillane began his legal career in 2000 as an assistant district attorney for the Northwestern District Attorney’s Office first as a prosecutor for the District Court then from 2004 to 2011 as a prosecutor for the Superior Court. Since 2011, he has served as assistant district attorney for the Bristol District Attorney’s Office. In his community, Attorney Cahillane has volunteered for the Bristol District Attorney’s Office Volunteer Program, the Salvation Army, and the Fall River Shannon Community Safety Initiative. He received his bachelor’s degree from St. Anselm College in 1992 and his juris doctor from Suffolk University School of Law in 1999.

             (Boston Orange 綜合編譯) 波士頓發展計畫局 (BPDA) 預定明年1月或2月，重新為位於天滿街的12號地段招標。

              波士頓商業期刊 (BBJ)指出，4年前，波士頓計畫發展局批准由亞美社區發展協會 (ACDC)和千禧年夥伴 (Millennium Partners)等機構及公司，在雙樹 (Double Tree) 酒店旁，天滿街290號的這塊12號地段上，蓋一棟350平方呎高的大樓，其中包括150戶有收入限制的可負擔共管公寓。

            雙樹酒店業主Corcoran Jennison公司和塔芙茨醫療中心也都是發展團隊成員之一。

              過去這2年多來，受新冠病毒疫情影響，無論是醫療護理、酒店，或者住宅市場，都大受打擊，原定的發展計畫，命運難訂。波士頓計畫發展局去年因此決定取消已批准的發展權。

             不過就在今年感恩節之前，波士頓計畫發展局向社區民眾做了一次簡報，打算明年招標，而且打算根據聯邦航空局的規定，蓋36層高大樓，並包括盡量多的可負擔住宅。

             波士頓計畫發展局草擬的招標書註明，發展計畫必須包括符合民眾需要的零售或小企業店面，以及少量的停車位。

World Record Holder, World Champion, Six Boston Winners to Square Off at 127^th Boston Marathon

BOSTON—The Boston Athletic Association (B.A.A.) proudly announced today that marathon world record holder and double Olympic marathon gold medalist Eliud Kipchoge, as well as reigning World Athletics Marathon champion Gotytom Gebreslase, will each make their Boston Marathon debuts in April, joining six distinguished Boston Marathon champions on the starting line of the 127^th Boston Marathon. Among the Boston Marathon champions set to race are reigning winner Evans Chebet of Kenya and Des Linden, the most recent American open division champion.

 

The 127^th Boston Marathon will be held on Monday, April 17, 2023 – Patriots’ Day in the Commonwealth of Massachusetts—and will feature 30,000 participants.

 

“The B.A.A. is bringing the world’s best to Boston to compete on the renowned 26.2 miles from Hopkinton to Boston,” said Mary Kate Shea, B.A.A. Director of Professional Athletes & Technical Support. “World record holder and Olympic champion Eliud Kipchoge, World Champion Gotytom Gebreslase and six Boston Marathon winners will challenge themselves, each other and a deep field of accomplished athletes on our sport’s famed stage.”

 

Defending Boston Marathon champion Chebet, 2021 winner Benson Kipruto, and two-time victor Lelisa Desisa (2013 and 2015) will be part of an historically deep men’s open division. Among the returning champions in the women’s field are Linden (2018), Edna Kiplagat (2017) and Atsede Baysa (2016). 

 

As the fastest marathoner in history, Kipchoge will take on the challenging Boston Marathon course with hopes of earning his eleventh win at an Abbott World Marathon Majors event. Kipchoge’s last marathon resulted in a new world record when he timed 2:01:09 for the win at September’s Berlin Marathon. Kipchoge’s lifetime best is 1:59:40, run at the INEOS 1:59 Challenge exhibition event in 2019 where he became the first man ever to cover 26.2 miles in under two hours. The 38-year-old looks to become the only man in history to have established a marathon world record, won two Olympic marathon gold medals, and break the tape first in Boston over the span of their career.

 

“I am happy to announce in April I will compete in the Boston Marathon, a new chapter in my Abbott World Marathon Majors journey,” said Kipchoge. “Good luck to all the runners running Boston in 2023.”

 

Joining Kipchoge among the contingent from Kenya is Evans Chebet, who stormed to a 2:06:51 win at April’s Boston Marathon then ran to victory at the TCS New York City Marathon in November. In 2022, Chebet became just the sixth man in history to win the Boston and New York City Marathons in the same year.

 

“To be a champion in Boston is something very special and for me it has even more meaning because it took me quite some time during my career to be competitive enough to finally win the oldest marathon in the world,” said Chebet. “I can’t wait to be back and to enjoy the great atmosphere of such a unique and historical race!”

 

Chebet’s training partner, Benson Kipruto, also returns; he won the 2022 Chicago Marathon in addition to claiming Boston in October of 2021.

 

“Boston is more than simply a place for me to race,” said Kipruto. “It has become so familiar to me that just the idea of making the journey there once again gets me kind of emotional. Even now, in these months to come, I promise to concentrate and dedicate my time and training to be at my best and to ensure that I will honor this special opportunity, once again. Thank you Boston for having me back!”

 

Desisa enters Boston with vital experience, having placed in the top-two four times at the Boston Marathon (wins in 2013 and 2015 and second-place finishes in 2016 and 2019). April marks the ten-year anniversary of his victory in 2013, one in which he donated his champion’s medal back to the City of Boston in recognition of the tragedy of April 15, 2013.

 

“There is no one in athletics who will be more focused than me this spring in racing, as I look to once again win the Boston Marathon,” said Desisa. “Ten years since my first victory – I understand what this anniversary means and I would love nothing more than to put my name into the history of the race again. I stand with the people of Boston and I will be running the race of my life for you all. We are Boston Strong!”

 

While this will be Gotytom Gebreslase’s first Boston Marathon, it is far from her first time racing in Boston. The Ethiopian world champion has finished runner-up at the B.A.A. Half Marathon twice and has placed in the top-five three times at the B.A.A. 5K on Patriots’ Day weekend. Beyond winning a world title in 2022, Gebreslase placed third at both the Berlin Marathon and New York City Marathons this year.

 

“I am very happy to compete in the Boston Marathon 2023, as Boston is one of the most famous races in the world,” said Gebreslase. “It has long been a dream of mine to win the race. When I was a young track athlete, I raced many time in Boston in indoor races and then on the roads in the B.A.A. 5K. So, I am very excited and happy to bring my career full circle and come back to Boston now as the World Champion with a chance to add the Boston Marathon Champion to my resume! See you on the start line!”

 

Representing America is Linden, racing in her tenth Boston Marathon. April’s race will mark the five-year anniversary of her memorable 2018 victory in the torrential rain, when she ended a 33-year American women’s drought in the open division. Linden has five top-five finishes, a win and a runner-up placing to her name in Boston.

 

“I’m excited about where my fitness is relative to last year,” said Linden. “Now it’s time to get the result to validate the work. I look forward to returning to the Boston Marathon, getting on the course I know and love, gaining momentum from the best fans in the sport, and recapturing some magic from the greatest marathon in the world.”

 

Edna Kiplagat set a new Masters Division record en route to finishing fourth at the 2022 Boston Marathon in 2:21:40, and shows no signs of stopping. Kiplagat plans to return and contend at the age of 43; she won the 2017 Boston Marathon in 2:21:52 and crossed the line second at both the 2019 and 2021 editions of the race.

 

Atsede Baysa rounds out the women’s open division returning champions. After finishing eighth at last year’s Boston Marathon, Baysa placed fifth at the Houston Marathon and looks to return with high hopes of another podium in 2023.
