 U.S. Citizenship Act Makes Strides for Pathway to Citizenship, Family Immigration

Asian Americans Advancing Justice welcomes immigration bill as a start to a more inclusive immigration system

Washington, D.C. – Congresswoman Linda Sanchez introduced the U.S. Citizenship Act, President Biden’s immigration proposal that would offer 11 million undocumented immigrants living in the U.S. a path to citizenship with a faster path for DACA recipients and Temporary Protected Status holders. Senator Menendez plans to introduce the same legislation on Monday in the Senate. Among other provisions, the bill also includes Congresswoman Judy Chu’s Reuniting Families Act and her No Ban Act, two pieces of priority legislation for Asian Americans Advancing Justice.

Asian Americans Advancing Justice, an affiliation of five independent Asian American civil rights organizations, issues the following statement: 

“Tireless advocacy from organizers and communities across the country has led to the inclusion of key measures that will start the process of truly transforming our deeply flawed immigration system. Asian Americans Advancing Justice commends the President and Congressional leaders in their fulfillment of a campaign promise to offer a path to citizenship for the 11 million undocumented immigrants, DACA recipients, and TPS holders that includes 15,000 people from Nepal. Yet several key aspects of the bill fall significantly short of the long-term promise to undo harms levied against immigrants and transform our immigration system.

We celebrate the inclusion of Congresswoman Chu’s Reuniting Families Act and the No Ban Act in today’s legislation. The No Ban Act would restrict the executive power to enact future discriminatory bans such as the Muslim and African Bans and prohibit religious discrimination in our immigration laws. The Reuniting Families Act would start to clear the family-based and employment-based backlogs, providing relief to separated families and Indian families stuck in temporary nonimmigrant visa status. The bill also includes LGBTQ equality provisions in our immigration laws, repeals the harsh three and 10-year and permanent bars to inadmissibility and other relief for immigrant communities. It would also expand the diversity visa program, a main pathway for immigrants from Africa.  

While these provisions would positively impact many Asian American and Arab Middle Eastern Muslim and South Asian (AMEMSA) community members, the bill includes harmful provisions as well. Specifically, the bill includes new additional criminal grounds of inadmissibility which will further punish vulnerable members of our communities. Immigrants with criminal convictions have already suffered cruelty and racial targeting in our justice system; they should not be doubly punished. The provisions originally in the Reuniting Families Act provided vital protections through waivers, but those presented in this bill fall short and exclude some community members. This comes at a time when large numbers of Southeast Asian refugees continue to be ripped from their communities and deported, often to countries they have never known and mass prosecutions of Asian American and immigrant scholars for espionage-related and large numbers of Asian American and immigrant researchers and scholars are being profiled, targeted and prosecuted for espionage and related crimes when they are not spies.  

Asian Americans Advancing Justice will continue to strive to build support in Congress and among the public for truly transformative change in our immigration system including for those with criminal convictions.”

查理貝克擔心疫苗斷供 考慮派國家衛隊去肯塔基、田納西搬運

(Boston Orange周菊子綜合報導)麻州州長查理貝克(Charlie Baker)(18)早在大波士頓商會(GBCC)的政府事務研討會中表示,考慮派國家衛隊到田納西州和肯塔基州,去把新冠疫苗運回麻州。

查理貝克表示,麻州大約每週從聯邦政府那兒收到12萬劑新冠病讀(COVID-19)疫苗,但州內各疫苗站的索取要求,卻高達40劑,可見麻州施打疫苗的效率可以更高,問題是麻州拿不到那麼多疫苗。他也衷心希望強生強生(Johnson & Johnson)只需要施打一劑的疫苗早日面市,所有相關工作就可以簡化許多。

查理貝克指出,由於美國其他地區的天氣狀況,聯邦政府已通知麻州,未來的疫苗運送,可能會有個兩三天延遲。昨天晚上,州政府又接到電話,指下一批疫苗的運送,將有更大程度延誤。

查理貝克表示,他正在和國家衛隊洽談,請他們到目前疫苗放置地點的肯塔基州(Kentucky),和田納西州(Tennessee),去把疫苗帶回來。麻州需要做的是確認聯邦政府會讓國家衛隊為麻州做這事。

查理貝克說,麻州不能夠坐等在那兒,一整個星期都拿不到聯邦政府預定要給,人們也都殷殷期待的疫苗。要以每週12萬人注射第一劑新冠疫苗的速度,來讓大約500萬人接種疫苗,得花很多時間,這也是為什麼,許多州的州長都很焦慮的等著看強生強生公司所研發疫苗,送交聯邦藥品局(FDA)審核後的進展。我估計大概下星期就會有結果。

在回應大波士頓商會董事長暨執行長James Rooney的提問時,查理貝克坦言,他會很想念波士頓市市長馬丁華殊(Martin Walsh)。查理貝克說,在當選麻州州長前,他和馬丁華殊並不熟,但上任後,他們幾乎每天通電話,成為很好的朋友。他認為州市政府就要有這樣的良好互動,才能攜手為人民提供更好的服務。

波士頓市長頒行政命令 撥200萬元支持平等採購政策

 

              (Boston Orange編譯)波士頓市長馬丁華殊218日宣佈,根據剛完成的差距研究報告,頒發行政命令,投資200萬元,設立供應商多元化項目,以支持平等的採購政策,鼓勵少數族裔及婦女所擁有企業爭取波士頓市採購合約,擴大他們得到訂單的機會。

直到現在以前,市府仰賴族裔及性別的辦法來鼓勵小企業參與競標市府合約。新頒的行政命令將採行對族裔及性別更為警覺的框架,以因應現有的不公平。

差異研究報告發現,在201471日至2019630日之間,市府的採購合約只有11%給了少數族裔及婦女所經營企業,但該研究的分析顯示,其實有16.9%的合約可提供給該類企業。

波士頓市長的行政命令將啟動數項關鍵改革,包括:

            1. 立即設立向少數族裔及婦女所擁有企業的總體市府採購目標,以25%為準,15%給婦女所擁有企業,10%給少數族裔所擁有企業。市府將以統一採購程序來達成這一目標。

             2. 從會計年度2023年起,把目標追蹤及報告列為年度預算程序。預算管理辦公室將要求每個部門繳交書面採購報告,總結前一會計年度中的採購活動,以及是否達到了合約目標,未來計畫如何達到目標。這是在平等採購計畫(Equitable Procurement Plan)”之外,要由預算管理辦公室員工,平等及包容單位,以及各部門自己研議,審核的。

            3. 設立供應商多元化項目以監管這行政命令,以及2019年和平等採購有關行政命令的執行。

             經濟發展辦公室的平等及包容主任Celina Barrios-Millner表示,市府的開銷應反映作為一個城市的價值觀。這行政命令是向該使命再邁進的關鍵步驟。

             波士頓市政府聘請了BBC研究諮詢公司來設計,執行這18年來的第一個差距研究,旨在辨識並處理這差距,最終強化市府所有部門的採購實務。

            BBC和波士頓市的平等及包容單位訪談了570多家本地企業,其中包括許多是少數族裔及婦女所經營的企業,以了解他們爭取市府合約的經驗,以及本地市場情況。

             BBCCodman廣場,柯普利,東波士頓,費爾茲角落,牙買加平原,麥特潘,洛士百利等地,舉辦了7場論壇,並取得書面,口頭證詞。他們也和由24名地方上企業主和活躍人士組成的供應商多元化顧問會每季開會討論。         

波士頓市市長馬丁華殊在2019年推出經濟發展中心,為深入每一鄰里,每一行業,提供小企業資源,致力深化專業關係,獲取多元化販售商,奠定了基礎。

2020年,有576家企業主參加了活動,此外市府還設立了認證企業舒緩金,迄今已分發180萬元來幫助132家本地認證企業因應新冠病毒大流行所帶來的經濟衝擊。

波士頓市府將舉辦三場說明會,分享這差距研究報告,以及彌平本地少數族裔及婦女企業所指認障礙的下一步作法。這三場會議都將在網上舉行,將有廣東話,西班牙文,越南文等多種語言翻譯。

新冠疫苗預約網站今早垮了 民眾、州長都氣瘋了

             (Boston Orange 周菊子綜合報導)麻州州長查理貝克(Charlie Baker)昨天才宣佈今(18)日會有7萬個疫苗注射機會可供登記,今天一早就發生網站垮了的情況,近2小時,沒人可完成預約手續,人們氣壞了,查理貝克說他也氣瘋了(My hair’s on fire)

             查理貝克強調他知道注射新冠疫苗對人們來說有多種要,網站一定會盡快修復的。他說,政府員工為這花了很多時間做準備,但顯然做得還不夠。

             今日早上8點左右,許多人上網登記,想要預約疫苗注射時,卻在螢幕上看到這應用程式壞了(crashed)”的訊息。

疫情指揮中心發言人說,vaxfinder.mass.gov這網站的同時上網登記人數太多,讓預約注射疫苗網站出現技術障礙。大約10點左右,這網站開始時不時的可以登入了,11點多時,麻州政府在推特上說,春田(Springfield),丹佛(Danvers),納提克(Natick),以及達特茅斯(Dartmouth)這幾個疫苗注射站的預約登記,連下星期都已經滿額了。

麻州參眾議會昨天才正式宣佈要召開聯席聽證會,請州政府說明為什麼疫苗分發注射作業動作那麼慢,並訂出225日將舉行第一次聽證會。麻州參議會議長Karen E. Spilka說,她非常失望,在這個原本應該讓人充滿希望的時刻,卻有那麼多的麻州居民感到沮喪。她希望在25日的聽證會上能從該為這挫敗負責的人那兒聽到些答案。

聯邦眾議員克拉克(Katherine Clark)表示,麻州需要的是能夠配合需求數量的系統,設立一個等候名單,民眾就不需要每分鐘或每小時的湧向網站,從一個鏈接跳到另一個鏈接的辦理預約登記。

波士頓環球報關於注射疫苗預約網站垮了,州長氣瘋了的這篇文章,有不下400多人留言,有人批評麻州政府早從6個月前就在做準備了,卻還出現這樣的情況,是查理貝克的錯,但民主黨為什麼沒有好好監督。有人說,票王(Ticketmaster)這售票網站可以在同一時間處理來自全美各地的訂票,麻州只是做一個州的預約登記,竟然都做不好,可見私營企業和公家機構的效率的確有差。也有人批評,投票索取身份證明就不合哩,預約注射疫苗索取身分證明就可以。有人抱怨,好不容易登入了網站,也看到了有預約空位,可是還沒等填完表格,所有的空位就都已經不見了。有人批評實施辦法不好,認為如果縮小每次開放登記的年齡段,就不會一下子同時湧出那麼多人登記,壓垮網站。

February 18, 2021—Washington, D.C.—Tonight, the American Bar Association will honor Advancing Justice | AAJC President and Executive Director John C. Yang with the Spirit of Excellence Award alongside four other esteemed civil rights leaders. The Spirit of Excellence Award celebrates the efforts and accomplishments of lawyers who work to promote a more racially and ethnically diverse legal profession. 

The awards are presented to lawyers who excel in their professional settings; who personify excellence on the national, state, or local level; and who have demonstrated a commitment to racial and ethnic diversity in the law. Sherrilyn Ifill, president and director-counsel of the NAACP Legal Defense and Educational Fund, and Lori E. Lightfoot, the first Black female mayor of Chicago, are among the honorees.

"The ABA's Spirit of Excellence Award is a hard-earned and well-deserved recognition of John Yang's incredible history of professional success coupled with innovative leadership for Asian Americans, not just in the legal field, but in community service, civil rights, and social equity, said Advancing Justice | AAJC Board Chair Parkin Lee. “We at Advancing Justice |  AAJC are truly fortunate that John had agreed to lead and grow our organization, enabling it to take on an ever-expanding portfolio of issues affecting the Asian American community through these tumultuous times."

Yang is an experienced attorney with over two decades over 25 years of policy, litigation, and corporate expertise. He served in the Obama Administration as Senior Advisor for Trade and Strategic Initiatives at the U.S. Department of Commerce, where he was the principal advisor to Secretary Penny Pritzker on issues related to Asia and worked with the White House and other U.S. agencies on strategic and economics issues concerning the region. He co-founded the Asian Pacific American Legal Resource Center, a nonprofit organization dedicated to addressing the direct service legal needs of Asian Pacific Americans in the D.C. metropolitan area and is a former president of the National Asian Pacific American Bar Association (NAPABA) where he continues to serve as co-chair of NAPABA’s Judiciary and Executive Nominations and Appointments Committee.

“I’m honored to receive this award, especially among friends and trusted colleagues with whom we have worked to advance racial and social equity over the years,” said John C. Yang. “I’m grateful every day to lead an organization that combats hate and xenophobia, advocates for a more humane immigration system, and ensures that Asian Americans are included in advocacy, public policy, and media. 麻州出現南非變種新冠病毒

             (Boston Orange 編譯)麻州出現新的新冠病毒(COVID-19)變種了,繼英國,巴西變種之後,這回的變種來自南非。

             麻州公共衛生廳(MPH)216日宣布,麻州出現源自南非的第一宗B.1.351新冠病毒變種。博德研究院(Broad Institute)為麻州公共衛生廳作的基因測序,證實了這一病毒變種。

             染有南非變種病毒的是一名住在米斗塞郡(Middlesex)20多歲女生,但她並無旅遊史。

             B.1.351這南非變種病毒已知很容易傳染,麻州公共衛生廳正和許多醫療及學術機構合作,就確診樣本的部分元素做基因測序,以快速辨識他們關注的變種。

             另外兩個已知的病毒變種為源於英國的B.1.1.7,以及源自巴西的P.1。麻州境內目前有34宗英國變種病毒案例,但還無巴西變種病例。

11民團爭【疫苗平等】提5點要求 促州府撥1000萬元

            (Boston Orange綜合編譯)11個民權、移民正義及公共衛生團體新組成的「疫苗平等聯盟(Vaccine Equity Now! Coalition)」,今(17)日發出聲明,提5點要求,籲請貝克政府處理疫苗施打計畫出現嚴重的族裔不平等現象。

            「波士頓黑人新冠病獨聯盟(Black Boston COVID-19 Coalition)」的執行委員Atyia Martin博士表示,人們命懸一線。

            「麻州移民及難民援助處(MIRA)」執行長Eva Millona表示,新冠病毒擴大了原本就已存在於美國的結構性不評等,導致有色社區及移民社區受到不成比例的衝擊。這些差距強調了為什麼疫苗施打必須以受這危機影響最大的群體為中心。

            他們指出,根據州政府數據,黑人及拉丁裔居民的確診率及住院率不成比例的高,但當疫苗終於出後,接種疫苗的白人居民卻更多。截至上週,白人居民接種疫苗的比率是黑人的12倍,拉丁裔的18倍。

            「疫苗平等聯盟」的5點要求包括,撥款1000萬元給可信賴的社區組織,執行外展工作,鼓勵有色社區參噢;立即實施州長允諾的多發20%疫苗給最受影響社區;仿照黑人及拉丁裔居銀所受到的不成比率影響,訂定清楚的追蹤疫苗基準;全方位改善疫苗外展及施打作業上的語言及文化適應性;指派有權威及責任心的疫苗專家來處理疫苗不平等問題。

            多徹斯特的麻州眾議員Liz Miranda已提出了「疫苗平等」法案。波士頓的麻州參議員陳翟蘇妮(Sonia Chang Diaz)也是「疫苗平等」法案提案人之一,她說,「平等不會偶然就發生」。

            根據州政府在疫苗剛出來時,1224日公佈的數據,在麻州收到並施打出去的疫苗中,55%白人,3%黑人,4%亞裔,4%拉丁裔,15%多種族,19%不確定。

麻州參眾議會2/25開聽證會 質詢貝克政府疫苗施打作業

             (Boston Orange 編譯)麻州的新冠病毒疫苗施打率,從29日的57.8%217日的79.2%,已有長足進步。但麻州參眾議會因人們批評疫苗施打動作太慢,又不公平,訂225日起舉行一連串監督聽證會,要州政府說明,

             麻州參議會議長Karen E. Spika,以及眾議會議長Ronald Mariano(17)日表示,將舉行聯席會議,要求貝克政府就疫苗分發作業,以及未來的分發計畫做說明。第一場預定225日舉行。

             麻州的疫苗分發施打作業,近日已大幅改善,麻州健康及人民服務長Marylou Sudders財報告過,麻州已施打100萬劑疫苗。不過麻州議會,以及地方,甚至全國性層級的領導們不斷向查理貝克施壓,要求他處理持續的族裔差距,改善登記流程,並讓不同的弱勢團體享有優先權。

             麻州參議會議長Spika表示,他們聽到麻州各地人們,對疫苗施打計畫的不斷改變,令人困惑,感到沮喪,憤怒,議會因此要用議會可用的工具來幫助人民得到答案,尤其是未來可以有什麼期待。

她說,要改善疫苗施打速度,尤其是在那些受打擊最嚴重社區及人口中的疫苗施打效率,包括身體有病而脆弱,殘障,老師,有色社區等,就必須進一步了解貝克政府的計畫。

麻州參眾議會很少舉行監督聽證會,上一次是2019年一宗發生在新罕布夏州,導致7名機車騎士死亡事件,讓麻州汽車監理處深陷危機,麻州參眾議會舉行了一次長達7小時的聽證會,查找麻州汽車監理處內部到底都犯了那些錯。

麻州參眾議會表示將舉行一系列的聽證會,但並未明說會邀請那些州政府官員出席說明。
